# Fair Housing for Rental Owners: How to Advertise, Screen, and Deny Applicants Without Creating a Complaint

by [Tara Lezama](https://www.thebbgrouprealtors.com/coldwell-banker-vanguard-realty-blog/author/tara-lezama) | Nov 4, 2026

Most fair housing complaints against rental owners do not start with someone who set out to discriminate. They start with a listing that said too much, a conversation that went off script, or a denial that nobody wrote down. As a Jacksonville property manager, I see how easily a well-meaning owner can create a problem in one sentence of ad copy or one text message to an applicant.

This post walks through the three places owners get into trouble most often: advertising, screening, and denying an application. It is meant to get you thinking, not to replace your attorney. I am not a lawyer, and this is general information, not legal advice. For legal questions, talk with your own attorney, or contact [The Florida Bar](https://www.floridabar.org) to find one.

## Who Is Protected

The federal Fair Housing Act protects seven classes: race, color, national origin, religion, sex, familial status, and disability. Florida's Fair Housing Act, in section 760.23 of the Florida Statutes, lists the same seven. Local ordinances can add more, so a rule you learned in another city or state may not match what applies here. The law applies to your listing, your showings, your screening, your lease terms, and the way you treat a tenant after move-in.

Owners who self-manage often assume the rules only apply to large companies. I treat every property as covered. If you believe an exemption applies to you, ask your attorney before you rely on it.

## Advertising: Describe the Home, Not the Person

The safest listing talks about the property. It does not talk about who should live there. Phrases that sound friendly can read as a preference or a limitation.

| Risky wording | Safer wording | Why it matters |
| --- | --- | --- |
| "Perfect for a young professional couple" | "Two bedrooms, two baths, close to downtown" | Family makeup should not shape who feels welcome. |
| "No children" | Use a reasonable occupancy limit applied to everyone | Familial status is a protected class. |
| "Walk to church" | "Walkable to shops and parks" | Religious references can signal a preference. |
| "Not suitable for wheelchairs" | Describe features, such as "second-floor unit, 14 steps" | Let applicants decide what works for them. |
| "Quiet, mature neighbors" | "Quiet cul-de-sac" | Describe the setting, not the people around it. |

The same rule applies to photos, social media posts, and yard signs. If your ad would make a reasonable reader think a certain group is unwelcome, rewrite it.

## Screening: Write the Criteria Once and Use Them Every Time

Consistency is your best protection. Before the first showing, put your screening criteria in writing and give the same document to every applicant. Mine cover income as a multiple of rent, credit and court history, rental history, how criminal history is evaluated, and pet and occupancy rules.

A few habits keep the process clean:

- Apply the same income, credit, and rental history standards to every applicant, in the same order.
- Offer the same showing options, the same application, and the same response time to everyone.
- Keep conversations about the property and the process. Skip small talk about family plans, religion, country of origin, or health.
- Evaluate criminal history individually, considering the nature of the offense, how long ago it happened, and its relevance to the tenancy, and ask your attorney how to write your policy.
- Use a reasonable occupancy standard that applies to every household the same way.

## Accommodations and Modifications

Applicants and tenants with disabilities can request a reasonable accommodation, such as an exception to a no-pets rule for an assistance animal. These requests do not need special words and can come by phone, text, or in passing. Do not ignore a request or answer with a flat no. Respond in writing, ask only what the law allows, and get advice before you deny one. I cover the assistance animal question in more detail in my post on emotional support animals.

## Denying an Application

A denial is where a complaint usually begins, because it is the moment an applicant looks for a reason. Protect yourself with a simple process:

- Deny based on a written criterion the applicant did not meet, and say which one.
- Keep the application, the screening report, and your notes for every applicant, not only the one you denied.
- If your decision relied on a consumer report, such as a credit or background report, even in part, the federal Fair Credit Reporting Act requires you to notify the applicant. The FTC says the notice should identify the reporting agency, state that the agency did not make the decision, and explain the applicant's right to dispute the report. The FTC calls written notices best practice.
- Offer the unit to the next qualified applicant in order, and note when you did.

## What Happens When Someone Files

An applicant who believes they were treated unfairly can file a complaint with HUD or the Florida Commission on Human Relations, or can go to court. Complaints often start from a screenshot of a listing or a text message. A complaint costs you time and legal fees even if you did nothing wrong, so a clean paper trail matters.

## Questions to Bring to Your Attorney

- Do my written screening criteria and application hold up under fair housing law?
- How should I write my occupancy and criminal history policies?
- What should my denial letters and adverse action notices say?
- How should I respond to an accommodation request, and when should I call you first?
- Does any local ordinance add protections beyond the federal and state lists?

## Frequently Asked Questions

### Can I refuse to rent to someone because of a past eviction?

Rental history is a common screening factor when you apply the same written standard to every applicant. Put the standard in writing before you advertise, and ask your attorney to review it.

### Can I say "no pets" in my listing?

A no-pets policy is common, but assistance animals are not pets under fair housing law, so you still have to consider an accommodation request.

### What if I only rent one house?

Do not assume you are exempt. Ask your attorney before relying on any exemption.

### Do I need to keep records on applicants I did not choose?

Yes. Keep the applications, screening results, and your notes for every applicant on the unit. They show you used the same process for everyone.
