# Do You Need a Realtor to Sell Your House in Florida? Pros, Cons, and Costs

by [Tara Lezama](https://www.thebbgrouprealtors.com/coldwell-banker-vanguard-realty-blog/author/tara-lezama) | Sep 19, 2026

A few years ago a homeowner in Jacksonville told me she had already decided to sell on her own. She had a yard sign, a Zillow account, and a neighbor who had done it once. Three weeks later she called me, not because the sign wasn't working, but because a buyer's agent had sent her a 14-page contract and she realized she did not know what half of it committed her to.

That moment is the real answer to the question most Florida sellers ask first. The question is not really whether you are allowed to sell without a realtor. You are. The question is what you are taking on, what you are giving up, and whether the money you keep is larger than the money you risk.

I am a REALTOR® and a licensed Mortgage Loan Originator, so I see both sides of a sale: the marketing and negotiation side, and the financing side that decides whether a buyer actually closes. In this article I will answer the question directly, walk through what a realtor does, lay out what it costs, and tell you honestly when selling on your own makes sense.

## Do You Need a Realtor to Sell Your House in Florida?

No, Florida law does not require you to use a realtor to sell your own home. An owner can list a property for sale by owner (FSBO), sign a purchase contract, and close the transaction without a licensed agent. What the law does require is that the sale be documented correctly, that you disclose known material defects, and that the title transfer through a proper closing.

So the legal answer is no. The practical answer is more nuanced, because a sale involves a stack of tasks that a realtor normally handles: pricing, marketing, showing, negotiating, contract management, and coordinating the closing. If you skip the realtor, every one of those tasks lands on you.

### What Florida actually requires of a seller

Florida is a state where attorneys are not required at a residential closing, but sellers still carry real obligations. Under the long-standing Florida case Johnson v. Davis, a seller must disclose known facts that materially affect the value of the home and are not readily observable to the buyer. Roof leaks, prior water intrusion, termite damage, and unpermitted work are common examples.

Sellers of homes built before 1978 must also provide the federal lead-based paint disclosure. Florida has also added flood-related disclosure requirements for residential sellers, so confirm the current form and rules before you list. If your property is in a homeowners association, you will need the association's documents and any governing rules the buyer is entitled to review.

### What a FSBO seller does without an agent

Without a realtor you are the marketer, the negotiator, and the project manager. You order your own photography, write the description, field inquiries, screen buyers, schedule showings, and respond to offers. You also choose and complete the contract, usually the Florida Realtors / Florida Bar residential contract or a version your closing attorney or title company supplies.

None of that is impossible. It is simply work, and it is work that has consequences when it is done poorly.

## What Does a Realtor Actually Do When Selling a House?

A listing realtor prices the home against current comparable sales, markets it across the Multiple Listing Service (MLS) and other channels, negotiates offers, manages the contract through inspection, appraisal, and financing, and coordinates the closing. The value is concentrated in a handful of moments where a mistake is expensive.

### Pricing the home against real comparables

Pricing is the decision with the largest dollar impact. A home priced too high sits, collects a stale listing history, and often sells for less than it would have if it had been priced correctly at the start. A home priced too low leaves money on the table that you will never see.

A realtor pulls recent closed sales, active competition, and pending sales in your specific neighborhood. In Jacksonville, that distinction matters. Riverside, Mandarin, Jacksonville Beach, and Nocatee can sit within a short drive of each other and behave like entirely different markets.

### Marketing and MLS exposure

The MLS is the database that feeds most of the major home-search portals and that other agents use to find homes for their buyers. Owners cannot list directly on the MLS. You can reach it through a realtor or through a flat-fee listing service, and the two are not the same in what they provide.

Professional photography, accurate measurements, a written description that answers buyer questions, and targeted online promotion all influence how many qualified buyers see the home in the first week, when attention is highest.

### Negotiation, contract, and deadlines

A Florida contract has deadlines for inspection, financing, appraisal, and title. Miss one, or misread one, and you can lose leverage or the deal. A realtor tracks those dates and knows how buyers commonly use inspection findings to renegotiate price.

Negotiation is also emotional. It is easier to hold a firm position on price when it is your representative, not you, hearing a buyer criticize your kitchen.

### Screening buyers and protecting your safety

Opening your home to strangers is a real consideration. A realtor pre-screens buyers, verifies pre-approval letters, and hosts showings so you are not walking unknown visitors through your home. As a loan originator, I can tell you that a pre-approval letter and a verified approval are not the same thing, and learning the difference after you have taken your home off the market is costly.

## What Are the Pros and Cons of Selling Without a Realtor?

The main advantage of selling without a realtor is that you avoid paying a listing agent's fee. The main disadvantages are that you take on all the marketing, negotiation, and legal risk yourself, and that you may attract fewer or weaker offers. Whether the trade is worthwhile depends on your home, your experience, and your timeline.

### The pros of going FSBO

You keep control over every decision, from pricing to showing schedules. You avoid the listing side of the commission, which is a real amount on a Jacksonville sale. If you already have a buyer, such as a relative, a tenant, or a neighbor, FSBO can be a reasonable and clean path.

### The cons of going FSBO

Most buyers are represented by their own agents, and those agents may steer clients toward homes where the process is smooth and predictable. Without MLS exposure and professional presentation, fewer buyers may see your home. Pricing errors are common, and so are contract mistakes.

There is also the matter of buyer-agent compensation. Since the industry's practice changes following the National Association of REALTORS® settlement, compensation offered to a buyer's agent is no longer published through the MLS and is a negotiated term. An FSBO seller who has not thought about this will still face the question when a represented buyer arrives.

### The hidden cost: time

Selling a house well is a part-time job for several weeks. Answering calls, scheduling showings around a work day, and reviewing paperwork all cost hours that have a value, even if they never appear on a closing statement.

## How Much Does It Cost to Use a Realtor in Florida?

Realtor compensation in Florida is negotiable and is not set by law. It is agreed in a written listing agreement, and it commonly covers the listing agent's services and sometimes an offer of compensation to a buyer's agent. Ask for the full structure in writing before you sign, including what is included, what is not, and what happens if the listing expires.

Beyond commission, sellers should budget for other closing costs whether or not they use an agent. These commonly include Florida documentary stamp tax on the deed, title-related charges according to local custom, any repair credits negotiated after inspection, prorated taxes, and payoff of your existing mortgage.

The right comparison is not commission versus zero. It is the net proceeds you would keep with a well-marketed, well-negotiated sale against the net proceeds from a self-managed sale, minus your own time and risk. I would rather you make that comparison with real numbers than take my word for it.

## FSBO vs. Realtor: A Side-by-Side Comparison

The table below compares the two approaches on the tasks that most affect a Florida seller's outcome. It is a framework, not a promise of results, since every home and every market moment is different. Use it to decide which tasks you are comfortable owning.

| Task | Selling FSBO | Selling With a Realtor |
| --- | --- | --- |
| Pricing | You research comparables yourself | Agent prepares a comparative market analysis |
| MLS exposure | Only through a flat-fee service, if you buy one | Included with a full-service listing |
| Showings and buyer screening | You schedule and host | Agent coordinates and screens |
| Negotiation | You negotiate directly | Agent negotiates on your behalf |
| Contract and deadlines | You manage, often with a closing attorney | Agent tracks and coordinates |
| Upfront cost | Lower, but you still pay closing costs | Commission agreed in the listing agreement |
| Your time | Significant | Reduced |

## When Does Selling Without a Realtor Make Sense?

Selling without a realtor makes the most sense when you already have a qualified buyer, when the transaction is simple, or when you have real estate experience and the time to manage the process. It makes the least sense when the home needs strong market exposure or the situation involves complications such as an estate, a short timeline, or an HOA.

### Situations where FSBO can work

Selling to a family member, a tenant already in the home, or a buyer you found yourself can be straightforward. Experienced investors who have closed many transactions often handle their own sales comfortably.

### Situations where I would strongly consider help

If you are relocating, if the home has known defects, if title questions exist, or if you are competing against new construction, professional representation earns its place. The same is true if you are selling a home in a flood zone or a coastal area, where disclosure and insurance questions can shape the buyer's decision.

### A middle path: limited-service options

Some sellers use a flat-fee MLS listing service and handle the rest. This can lower cost, but it also means you are the negotiator and the transaction manager. Ask exactly what the service includes and who answers the buyer's agent when a problem arises at day 20 of a 30-day contract.

### Where a lender's perspective helps

As a Mortgage Loan Originator, I look at offers through the buyer's financing. An offer with a strong cash down payment and a fully underwritten approval is a different offer than one with a loose pre-qualification, even when the price is identical. Reading that difference is a skill, and it protects your timeline.

## Frequently Asked Questions

### Can I sell my house in Florida without a realtor?

Yes. Florida law allows homeowners to sell their own property without a licensed agent. You remain responsible for required disclosures, a valid written contract, and a proper closing through a title company or attorney.

### Do I need a lawyer to sell my house in Florida?

Florida does not require an attorney for a residential closing, and many sales close through title companies. If you sell without a realtor, consulting a real estate attorney to review the contract and disclosures is a sensible precaution.

### How much does a realtor charge to sell a house in Florida?

Commission is negotiable and set in the listing agreement, not by law. Ask each agent to explain the total fee, what services it covers, and whether any portion is offered to a buyer's agent.

### Is it cheaper to sell a house without a realtor?

It can be cheaper on paper because you avoid the listing agent's commission. The real comparison is your net proceeds after accounting for price, time on market, and the cost of any mistakes.

### What is the biggest risk of selling FSBO in Florida?

The most common risks are mispricing the home and mishandling the contract or disclosures. Either can cost more than the commission you set out to save.
